NPP MP challenges EC over Kpandai seat despite court stay

Manhyia South MP Nana Adjei Baffour Awuah says Parliament’s decision to notify the Electoral Commission of a vacancy in Kpandai was premature, ignoring pending Supreme Court motions.

The Parliamentary Service wrote to the EC on December 4, 2025, confirming a vacant seat after a High Court ruling nullified the 2024 election of MP Mathew Nyindam and ordered a fresh poll.

Nyindam has since lodged an application at the Supreme Court seeking to overturn the High Court decision, including a motion for a stay of execution that, Awuah argues, should have halted any vacancy notification.

“I’m very surprised, extremely surprised because of the Speaker’s ruling last week. I’m so surprised because I am aware that a motion for stay of execution has been filed and the same has been served on the Clerk to Parliament,” Awuah said on JoyNews’ Top Story on Monday, December 8.

He added, “Having filed all these processes—particularly the motion for stay of execution pending determination—it looks like someone wants to beat all the legal processes. I don’t know why the haste. I am utterly surprised.”

Awuah stressed that Parliament must respect legal procedures, especially when electoral legitimacy and constituency representation are at stake, urging the Speaker to pause any administrative steps until the Supreme Court rules.

The apex court is expected to consider Nyindam’s motions in the coming days, a decision that could either uphold the High Court’s order for a re‑run or suspend the process entirely, leaving Kpandai voters in limbo.
