Former Tamale Central MP, Inusah Fuseini, has outlined conditions for the potential reinstatement of Matthew Nyindam as MP for Kpandai, amidst a constitutional dispute sparked by the Speaker of Parliament’s declaration of the seat’s vacancy.
Speaking on JoyNews’ The Pulse on Tuesday, December 9, Alhaji Fuseini explained that Mr. Nyindam’s return to Parliament depends on two crucial legal interventions.
“Matthew Nyindam will be reinstated if they arrest the implementation or operationalisation of the letter written by the Clerk to Parliament, and also stay the judgement of the High Court in Tamale,” he stated.
Alhaji Fuseini stressed that if these legal steps are taken, Mr. Nyindam’s position in Parliament would remain secure pending the final determination of the ongoing case.
His comments follow a controversial letter sent last week by the Parliamentary Service to the Electoral Commission (EC), confirming a vacancy in the Kpandai seat. The letter was based on a High Court directive calling for a fresh parliamentary election and cited Parliament’s constitutional obligation under Article 112(5) to inform the EC of such developments.
Signed by Clerk to Parliament, Ebenezer Ahumah Djietror, and addressed to EC Chairperson, Jean Mensa, the communication initiated the administrative process for a by-election to select a new MP for the constituency.
However, the Minority Caucus has vehemently opposed this move, demanding the immediate withdrawal of the letter. They contend that the action is unlawful, procedurally flawed, and inconsistent with the ongoing legal proceedings.
Meanwhile, Mr. Nyindam has filed an application at the Supreme Court seeking to overturn the High Court judgement that invalidated his 2024 election victory.
