Minority Demands Withdrawal of Kpandai Seat Declaration

Minority Chief Whip Frank Annoh-Dompreh has demanded the immediate withdrawal of Parliament’s official notification to the Electoral Commission (EC) regarding a vacancy in the Kpandai Constituency, labeling the action as unlawful and procedurally flawed.

Addressing Parliament on Tuesday, December 10, 2025, Annoh-Dompreh maintained that the letter – signed by the Clerk to Parliament on December 4, 2025 – was issued without due regard for proper procedure, particularly as a motion for a stay of execution is still pending before the court.

“We strongly submit that the letter that was filed with the Electoral Commission was out of place, was unfortunate, and flies in the face of law and procedural justice,” he stated.

“That letter must be withdrawn forthwith… Ghana is a fledgling democracy, and the least we can do is to support the procedure,” the Nsawam-Adoagyiri MP added.

Last week, the Parliamentary Service informed the EC of the vacancy in the Kpandai seat following a High Court order for a re-run of the 2024 Parliamentary Election in the constituency.

This notification officially initiates the process for a by-election to determine a new Member of Parliament for the area.

The letter, addressed to EC Chairperson Jean Mensa and issued by the Clerk to Parliament, Ebenezer Ahumah Djietror, referenced the constitutional mandate outlined in Article 112(5).

However, the Minority contends that the move is premature and potentially undermines ongoing judicial proceedings.

Annoh-Dompreh argued that Parliament should refrain from acting on the court’s directive until the application for a stay of execution has been fully resolved.

“We on this side of the House cannot support that decision,” he stressed. “The clerk must be instructed forthwith to withdraw that letter and act according to law.”

He further reminded the House of instances where bipartisan cooperation prevailed despite numerical disparities, urging the Speaker to uphold a similar standard of consistency and fairness in this matter.
