Court to Rule on Adu Boahen Case January 4

The Supreme Court has scheduled January 14, 2026, to deliver its verdict on a request by the Deputy Attorney-General to revisit aspects of its earlier ruling in the trial of former National Signals Bureau boss, Kwabena Adu Boahen, and his wife.

The couple is currently facing charges of stealing, money laundering, and abuse of office. They had previously sought to disqualify the High Court judge overseeing their case, but this application was dismissed.

The Supreme Court’s initial revision of the Practice Direction on Further Disclosures stipulated that prosecutors are only obligated to disclose materials in their possession directly linked to the case, rather than all potentially relevant information.

However, the Deputy Attorney-General, Dr. Justice Srem-Sai, has invoked the Court’s review jurisdiction, arguing that the initial bench effectively altered the Practice Direction by removing the requirement for ‘relevance’ without providing a substitute.

“This could compel legal practitioners to rely solely on whether materials are in possession, disregarding whether they have any bearing on the issues being tried,” Dr. Srem-Sai reportedly argued.

He is urging the Court to reinstate the term ‘relevance’ in its standard, commonly understood meaning, or to replace it with the phrase ‘connected with the matter before the Court’.

Dr. Srem-Sai maintains that a criminal disclosure process must necessitate a clear connection between the requested materials and the specifics of the case.

The outcome of this review will significantly impact the disclosure standards in criminal trials and could influence the proceedings against Mr. and Mrs. Adu Boahen.
