Reddit Challenges Australia's Social Media Ban in High Court

Reddit has launched a legal challenge in Australia’s High Court against the country’s new law banning children under 16 from social media platforms.

The online forum is one of ten social media giants – including Facebook, Instagram, and TikTok – now required to verify the ages of users and block access for those under 16, a policy that came into effect on Wednesday.

While complying with the ban, Reddit argues the law infringes on user privacy and political expression. This marks the second legal challenge to the legislation, with two Australian teenagers already pursuing a case claiming the ban violates the implied freedom of communication regarding political matters.

“Despite the best intentions, this law is missing the mark,” Reddit stated in an update on its website. “There are more effective ways for the Australian government to accomplish our shared goal of protecting youth.”

Australia’s Communications Minister, Anika Wells, has dismissed concerns about legal challenges, asserting the government will “not be intimidated by big tech.” She told parliament, “On behalf of Australian parents, we will stand firm.”

The teens’ case, scheduled for a High Court hearing at an unspecified date next year, echoes Reddit’s concerns. Macey Newland, one of the 15-year-old plaintiffs, told the BBC, “Democracy doesn’t start at 16 as this law says it will.”

The ban has garnered international attention, receiving praise from figures like Oprah Winfrey and Prince Harry and Meghan, the Duchess of Sussex, who called for a broader “reckoning” between society and tech companies prioritizing growth over safety. “We hope this ban is only the start,” they said in a statement.

However, the policy has faced criticism for being overly broad and potentially ineffective. Experts worry that young people will easily circumvent the age verification measures, potentially exposing themselves to even greater risks on less regulated platforms.

Concerns have also been raised about the ban’s impact on vulnerable youth, particularly those in LGBTQ, neurodivergent, or rural communities, who may rely on social media for connection and support. Mental health advocates argue the ban could isolate these individuals.

Reddit emphasized that its user base is predominantly adult and that it does not actively market to or target advertising at children under 18. The company believes the law imposes “intrusive and potentially insecure verification processes” and creates inconsistencies in which platforms are included.

The forum advocates for “more targeted, privacy-preserving measures” to protect young people online, rather than a sweeping prohibition. Reddit maintains its challenge is not about avoiding compliance or retaining young users, but about addressing fundamental concerns regarding privacy and freedom of expression.
