Kpandai Ruling Stands Unless Supreme Court Intervenes

The decision by Parliament to notify the Electoral Commission (EC) of a vacancy in the Kpandai Constituency is a straightforward constitutional obligation, according to Berekum West MP, Dickson Kyere‑Duah.

Speaking on the AM Show, Mr. Kyere‑Duah emphasized that Parliament is bound to respect the High Court’s directive for a re-run of the 2024 parliamentary election in Kpandai.

“This does not preclude my brother Matthew Nyindam from appealing the decision at the Supreme Court,” he stated. “Should the High Court’s verdict be overturned, the EC would naturally halt preparations for the re-run. As it stands, nothing has fundamentally changed.”

He clarified that Parliament’s action was merely a communication of the court’s order to the EC, as mandated by law. Mr. Kyere‑Duah further indicated that any future ruling from the Supreme Court or the Court of Appeal that contradicts the High Court’s decision will be promptly implemented by Parliament.

“A decision from any court will be respected by all,” he affirmed, adding, “Similarly, if an appeal court reverses the current ruling, Parliament will act accordingly.”

The MP’s comments followed the formal notification from the Parliamentary Service to the EC regarding the vacancy in the Kpandai seat. The notification, dated December 4, 2025, and signed by the Clerk to Parliament, Ebenezer Ahumah Djietror, officially initiates the process for conducting a re-run election.

The letter was issued in compliance with Article 112(5) of the 1992 Constitution, which stipulates that the Clerk to Parliament must inform the EC whenever a parliamentary seat becomes vacant.

The anticipated re-run election will ultimately determine the representative for the people of Kpandai in Parliament, following the annulment of the 2024 election results in the constituency.
