Accra High Court Rejects Wontumi Lawyers' Disclosure Request

Accra High Court on Monday dismissed the NPP Ashanti Regional Chairman Bernard Antwi Boasiako’s bid for further prosecution disclosures, ruling the application unfounded.

The defence team had argued that the documents were essential for preparing the case. Lead counsel Andy Appiah Kubi had informed the court on 25 November 2025 of plans to formally seek the disclosures, causing the matter to be adjourned.

During the hearing on 8 December, Deputy Attorney General Justice Srem Sai urged the bench to reject the request. Presiding Judge Audrey Kocuvie Tay reviewed the submissions and ruled against the defence, effectively striking out the application.

“The decision confirms our belief that the prosecution does not possess the requested documents,” Andy Appiah Kubi told journalists after the proceedings. He added, “We are fully satisfied with the outcome; it aligns with our expectations.”

Chairman Wontumi faces six criminal counts filed in October by the Office of the Attorney General for alleged breaches of Ghana’s mining laws. He is charged alongside Kwame Antwi and Akonta Mining Company Limited, his own firm.

The charges stem from alleged unauthorised mining activities at Samreboi in the Western Region, invoking key provisions of the Minerals and Mining Act 2006 (Act 703) as amended by the Minerals and Mining Amendment Act 2019 (Act 995).

The case now proceeds to trial, where the court will determine liability under the mining statutes. Observers note that the ruling may set a precedent for how disclosure requests are handled in high‑profile political prosecutions.
