NDC Seeks Contempt Charge Against EC Over Rerun Delay

The National Democratic Congress (NDC) Parliamentary Candidate for the Kpandai Constituency, Daniel Nsala Wakpal, has initiated contempt proceedings against Electoral Commission (EC) Chair, Jean Mensa, at the Tamale High Court.

Mr. Wakpal’s application, grounded in Article 99 of the 1992 Constitution and Section 16 of the Representation of the People Act, 1992 (PNDCL 284), stems from the disputed parliamentary election held in Kpandai on December 7, 2024. He is contesting the EC’s declaration of Matthew Nyindam of the New Patriotic Party (NPP) as the Member of Parliament-elect.

The NDC candidate alleges that Madam Mensa has willfully disregarded a directive from the Tamale High Court ordering a rerun of the Kpandai parliamentary poll. Counsel for Mr. Wakpal, in a motion filed under Order 50 Rule 1(2) of C.I. 47, is requesting the court to cite and potentially commit the EC Chair for contempt.

According to court documents, the failure to comply with the rerun directive prompted this latest legal challenge. This development adds another layer to the ongoing disputes surrounding the 2024 parliamentary elections in Kpandai.

The Tamale High Court has scheduled a hearing for the motion on December 23, 2025, where the matter will be further addressed. The outcome of these proceedings could have significant implications for the representation of the Kpandai Constituency in Parliament.
